little bit of an after shore wind. check it out, 61 degrees in oakland. 60 in vallejo but a cool 43 in santa rosa. they have a frost advisory in the north bay but i think it will be canceled shortly. more coming up. >> unfortunately, we have a hotspot already on the road. a traffic alert in effect an injury accident blocking the right lanes westbound 580 approaching first street. this is in livermore. it's also a construction area. the delays are already beginning to build. so a bad start to the morning commute in livermore valley. breaking news in colorado. about two hours ago denver police arrested two teenagers for breaking into a middle school last night. the teen boys had been seen carrying rifles and s.w.a.t. officers were called in. a short time ago police found the weapons. they are apparently bb guns. police say several classrooms at the school were ransacked. search for a gunman who old fire at a new jersey shopping mall is over. police say the 20-year-old took his own life. no one else was hurt.

cbs news' jericka duncan has more on this terrifying ordeal. reporter: police say 20- year-old richard shoop walked into the garden state plaza mall in paramus, new jersey, and opened fire. >> out of nowhere the guy walked right past the front door and like shooting shots in the air. he paused for a second and looked inside the store. i just froze. >> reporter: police quickly responded and s.w.a.t. team members stormed the facility. >> the shooter for whatever reason instead of staying and firing, fled deeper into the mall. >> reporter: officials locked the mall down and began april search for the suspect and anyone who may be hiding for safety. >> we go store by store room by room and that takes quite a while on 2.2 million square feet. >> reporter: authorities escorted individuals out of the store one by one as they cleared each room. >> it's okay to go. >> reporter: the cell phone video shows what it was like for the people coming out. >> let me tell you, it is the

scariest thing when you see the s.w.a.t. team coming waiting at the door for you to come out. >> reporter: shortly around 3 a.m. police found shoop dead. >> one of the s.w.a.t. teams here as we progressed through the night was able to locate the victim in the back room with a self-inflicted gunshot wound. >> reporter: authorities say appears shoop was on a suicide mission and didn't want to hurt anyone else, jericka duncan, cbs news, paramus, new jersey. >> that mall in paramus is one of the largest in the greater new york city area. the two tsa officers wounded in the los angeles airport shootings are now out of the hospital. one of them tony grigsby, spoke to reporters yesterday. he says he was trying to help an elderly man get to safety when the gunshot him twice in the foot. he was friends with gerardo hernandez, the tsa officer who was killed. >> only now it has hit me that i would never see him again. >> the third wounded person' passenger needs more surgery

and physical therapy but is in good condition. the fbi revisited paul ciancia's apartment yesterday. they left with one of his roommates, who drove him to the airport. investigators say there's no indication the roommate knew of ciancia's plans. 4:33. the parents of a teenager fatally shot by a sonoma county sheriff's deputy are taking legal action now. the family of andy lopez filed a federal lawsuit yesterday against the county and deputy erick gelhaus. the suit says the shooting was reckless and a violation of civil rights. the deputy opened fire after andy lopez refused orders to drop a fake weapon. >> we are going to prove through our investigation and our lawsuit that the shooting of andy lopez is absolutely and unequivocally unjustified. >> we want justice and then also we want an honest

investigation. >> gelhaus' attorney has said his client thought his life was in danger at the time. an attorney for the sonoma county says the lawsuit is premature and, quote, has the potential of interfering with the conduct of the full criminal investigation. a frantic phone call is the last anyone heard from a tourist in san francisco. kpix 5's christin ayers reports the man's family has come from brazil to find him. >> i'm in trouble. there are some people following me and i need help. call the police. call a taxi. send someone to find me. reporter: they are the last words on a haze heard from her brother paulo netto over the phone before he mystery us willly dips appeared one week ago. >> been to hospitals. been to shelters. >> reporter: but still no sign of paulo an art student studying in los angeles. he came to san francisco october 25th to look into studying at academy of art university. he was only supposed to stay

for a couple of days. but after meeting someone new, he extended his stay. when he called his family in brazil one week ago, anna knew something was terribly wrong. >> he sounded terrified, afraid, frightening. >> reporter: anna called san francisco police from brazil but when they arrived at the scene, no one was there. now police are circulating this. a surveillance shot of a person of interest who used paulo's credit card at a mcdonald's in the mission on halloween. nan wants to find that person and plans to stay in san francisco until she has some answers. >> something happened. we are sure about it. but we feel that we are going to find him. >> reporter: in san francisco, christin ayers, kpix 5. >> san francisco police say paulo may be in an altered state of mind. anyone with information is being urged to call police. 4:35. it's warm out there. >> yeah. mild in spots. getting a little bit of an

offshore wind. cool in the north bay valleys but we'll heat up nicely today these temperatures probably moving a little bit above the average. nice and clear out there over the bay bridge right now and all around the bay area looking good so far. it is 61 degrees if you can believe that in oakland. 58 in livermore. a cool 43, though in concord and 43 also in santa rosa. as we head in toward the afternoon hours, plenty of sunshine. these temperatures probably just slightly above the average toward the afternoon. 73 degrees looking nice in concord. 73 in livermore. and 70 degrees in san jose. we have put a couple of raindrops in the forecast. we'll tell you when in a moment. right now time for traffic with elizabeth. >> a traffic alert. still out in livermore still causing problems still blocking the right lanes an injury crash first reported around 4:00 so this is blocking lanes now for nearly who minutes. -- 40 minutes. approaching the first street exit. you can see from the sensors in the area, traffic is backing up a couple of exits. drive time 21 minutes between

hold more than 10 rounds with some exceptions. so anyone with 10 magazines with more than 10 rounds have to surrender them? >> no, they are grandfathered in and if they have a purchase price before that, it's fine. >> it's illegal. >> reporter: the representative of responsible citizens of california says the measure would hurt legal gun owners. for example, like not reporting a gun that was stolen while you're on vacation. thieves who get ammo sales records could track down owners and steal their guns. mandatory gun laws and lockers could slow down response in an emergency. and high capacity magazines have already been banned for years. >> that law is on the books in california. it's no change. it's redundant. >> reporter: if it passes, the nra has vowed to sue. the mayor says bring it on. >> our community i'm going to say is not afraid of the nra. >> reporter: in sunnyvale, kiet do, kpix 5. >> polls will be open from 7

a.m. to 8 p.m. we'll have full election results at our website, kpix.com. this bay area daycare worker is under arrest. morgan hill police say 58-year- old anna lopez showed up to work drunk. parents called police before 7:00 yesterday morning. they said something appeared to be wrong as they dropped their kids off at the p.a. walled child development center on main avenue. police say lopez smelled of alcohol. >> no harm, she definitely was drunk. the belief was that she was not airport care for the children's well-being so no harm but it didn't help her being intoxicated. >> lopez is facing felony child endangerment charges. a massive new travel casino set to open in sonoma county this morning. the $800 million great ton resort and casino near rohnert park off golf course west near highway 101. the facility includes 3,000 slot machines and hundreds of

gaming tables. it's expected to bring in half billion dollars in revenue in a couple of years. the state of california, sonoma county and the city of rohnert park will all benefit financially. but many people in the area have raised concerns about potential traffic jams. opening set for 10 a.m. coming up in our next half hour, how chp is planning on dealing with all the traffic on 101. people living in a public housing skyscraper in san francisco say the elevators don't work. residents at the clementina towers say the elevators are slow, skip floors and are out of order. some elderly and disabled were unable to leave their apartments recently when both were out at the same time. >> these elevators are breaking down constantly. if it's not one thing it's another. >> the housing authority says it's doing its best to keep up with repairs and maintenance on 30 elevators in 22 buildings. 4:40. just getting started. they are exploding in

there. the env a tugboat known as captain al is out of the oakland estuary more than 15 years after it was sunk there. the environmental protection agency said the 105-foot-long boat was a hazard to recreational sailors and released chemicals into the environment. captain al was raised as part of a two-month effort to clear debris from the estuary. ohio kidnapping survivor michelle knight has told her harrowing story to talk show host dr. phil. knight was one of three women held captive for more than a decade by ariel castro who killed himself in prison in september. >> so he gets you in this room.

cal where something is always getting lit up, it does look like it's lights out for the. ecigarette. in berkeley, andria borba, kpix 5. >> the ban starts in january. 4:46. how about weather? lawrence we're looking at a good day. >> looks like a great day. i think some warmer temperatures around the bay area, high pressure going to strengthen. even today starting out this morning temperatures a little more mild kind of all over the map right now. a variety of temperatures out the door, 40s and 50s, some in the 60s. out there we have had offshore winds so that mixes things out a bit. now, by the afternoon, we'll see temperatures up in the mid- 70s inland. you will see some upper 60s inside the bay and 60s a little cool out toward the coastline but sunshine again for everyone. how about this? that ridge continues to build in overhead. so we are going to see plenty of sunshine and warmer temperatures. that likely is going to hold for another day but then things begin to shift gears a little bit. in the meantime, warming right on through wednesday. that will be the peak of the

heat. then we'll start to cool down and maybe get ready for some rain. temperatures running in the 60s and the 70s into the south bay. low 60s toward the coastline. east bay numbers running up into the 70s in many spots a gorgeous day. inside the bay 66 in san francisco. 69 in alameda. and about 72 degrees in sonoma. next couple of days, we'll see some warmer weather then cool things down with more clouds on thursday. more sunshine but cooler temperatures heading into the weekend and, that's right, we have rain. could see some showers making a return on monday. let's check the roads with elizabeth. thanks, lawrence. unfortunately some people are going to be late to work. it is slow going right now through the livermore valley. westbound 580 is the hotspot this morning. so give yourself some extra time and maybe you want to wait it out. still no eto, but it's injury accident involving a big rig, a couple of other cars. the right lanes are blocked westbound 580 by first street. it looks like from our sensors we're picking up delays from at

least the truck scales, but again expect major delays. the delays are growing as those lanes continue to be blocked. this is one of our busiest commutes anyway at this time of the morning. now, except for thattive drew, so far, so good across -- except for that drive, so far, so good across the bay area. walnut creek walnut creek, westbound 24 moving well towards the caldecott tunnel and orinda. if you are heading into oakland this morning, this is a live look at the nimitz, 880. taillights a little difficult to see this morning but you can make out a few towards downtown oakland. no big roadwork projects. 15 minutes in the northbound lanes between 238 and the maze. southbound good, no problems getting to the oakland airport from the macarthur maze. farther south, this is a horrible commute yesterday. we had a series of accidents from hayward down into fremont. well, this morning everything is a fresh start and everything looks pretty good on 237 all the way towards sunnyvale. bart a great option and everything including more than 20 trains rolling on time. got any questions about your morning drive when you hit the roads? tune to our partners, kcbs 740- am and 106.9-fm.
